The case related to a fundamental rights petition filed by Sarath Fonseka calling for the issue of an order to release him has again been postponed.
The petition was taken up before a trial-at –bar headed by Chief Justice Ashoka de Silva. Based on a consensus between the petitioner and the respondents, the Supreme Court decided to postpone the hearing of the petition until the 2nd of February. Mr. Fonseka had filed this petition calling on the Court to issue an order saying that the initiative taken to arrest him under the Military law was illegal. However, the Court on several earlier occasions had to postpone the hearing as the objections related to the petition had not been submitted to the respondents.
