Open container now carries $500 fine or 30 days in jail

Violations for caring an open container of alcohol on public property in Columbja have jumped to a $500 fine or 30 days in jail.

Columbia City Council passed the ordinance this morning 6-1. Mayor Steve Benjamin voted "no" because he disagreed with the stiffer penalties.

The ordinance also removes a provision that required police officers to test the liquids to see if they contained alcohol. City officials said that provision had made the law unenforceable.

The law also adds beer and wine to the list of beverages that cannot be carried on public properties. The law does not apply to private parties or on private property, like your back yard or front porch.

The law is one of several recommended changes to the laws governing the city's nightlife after three shootings were reported in Five Points over the summer. Council is expected to vote on a curfew for anyone 17 and under later today.
