No judicial relief for Sarath Fonseka

Legal luminaries have pointed out that Mr. Fonseka is not in a position to seek judicial relief. They emphasized that the only alternative left for him is to seek a Presidential pardon.

Attorney Dr. Prathibha Mahanamahewa of the Law Faculty of the Colombo University said that the President should ratify a Court Martial verdict to be effective. It has been confirmed by him. As such no appeal can be submitted against it in a local, regional or international Court or in a UN Court. Even Local or foreign organizations cannot influence. It is because the ruling has been given by a local court. Mr. Mahanamahewa emphasized that since the President had confirmed the Court Martial ruling, it is he who has the power to alter it.
