The Attorney General has told the Appeals Court that the Court Martial is accepted by law and the decision taken by the Parliamentary Secretary General to vacate his Parliamentary seat is Constitutional.
Deputy Solicitor General Farzana Jameel made this reference to Courts on behalf of the Attorney General when Sarath Fonseka’s Writ Application was taken up for hearing today. The Parliamentary Secretary General decided to vacate his seat after the receipt of justifiable information that the petitioner had been convicted following the ruling of the Court Martial. It is in conformity with the Constitution. The Court Martial has been set up under the Army Act. As such the Deputy Solicitor General said the Court Martial was a recognized Court.
