The hearing of the Writ petition filed by former Army Commander Sarath Fonseka against the decision of the second Court Martial has been postponed.
The petition was taken up before a Panel of Judges consisting Justices Eric Basnayake and K.P. Chithrasiri. Judge K.P. Chithrasiri informed that he is unable to attend the hearing due to personal reasons. Accordingly it was decided to submit the petition to the President of the Appeal’s Court to appoint a new panel of Judges. The hearing will commence after the Appeal Court President appoints a new panel of Judges. Former Army Commander Sarath Fonseka has been sentenced to 30 months’ imprisonment. He has filed the petition seeking the withdrawal of the punishment meted out to him.
