The pleadings are misconceived in law and hence the petition should be rejected in limine, stated President’s Counsel D S Wijesinghe, Senior Counsel for President Mahinda Rajapaksa in his written submissions to Supreme Court.
The Supreme Court earlier reserved its order in the preliminary objections in the Presidential Election Petition filed by Sarath Fonseka.
The Bench comprised Chief Justice Asoka de Silva, Justice Dr Shirani A Bandaranayake, Justice K Sripavan, Justice P A Ratnayake PC and Justice S I Imam.
President’s Counsel Wijesinghe in his lengthy written submissions stated that the petitioner seeks to establish that the "election of the first respondent to the office of President of Sri Lanka is void and undue" on any one or more of the grounds specified in paragraph 7 (a).
