Court denies appeal in hospital case

A federal court has rejected a South Carolina hospital’s request to stop a new trial on whether the hospital boosted profits by submitting hundreds of millions of dollars in fraudulent Medicare claims.

A panel of the 4th U.S. Circuit Court of Appeals in Richmond, Va., on Tuesday denied the request by Sumter’s Tuomey Hospital.

In March, a federal jury ruled the hospital did not violate the federal False Claims Act, allowing Tuomey to avoid more than $227 million in fines and penalties. But the judge who heard the case later ruled he had wrongly excluded some testimony and ordered a new trial. Tuomey’s attorneys were trying to appeal that ruling.

The hospital was ordered to pay nearly $45 million for having an improper relationship with doctors. An appeal on that issue is still pending.
