The Attorney General (AG) raised an initial objection in the Appeals Court today saying that the petition filed by Sarath Fonseka calling for the revocation of the Second Martial verdict should be quashed without taking it for hearing.
The case was taken up before Appeals Court judges Eric Basnayake and Upali Abeyratne. Deputy Solicitor General Buvanaike Aluvihare appearing on behalf of the Attorney General said it is not possible to consider the petition before the law. The Court Martial had been endorsed by the President. As such, he emphasized a President’s action cannot be challenged by law. Under these circumstances, he pointed out that the petition cannot be taken up for hearing.
In the meantime, the petition filed by Mr. Fonseka earlier had been rejected by the Appeals Court. The Deputy Solicitor General pointed out that on such an occasion the Appeals Court cannot give a ruling on a similar point.
