Theravadi Bhikku Kathikavath Bill is inconsistent with the constitution:Supreme Court

The Supreme Court determined that the proposed Theravadi Bhikku Kathikavath Bill was inconsistent with the constitution. Speaker Karu Jayasuriya informed Parliament on this matter and noted that the they had determined that section two, subsection two, subsection three and subsection four, and section 11 – subsection two of the said draft bill were inconsistent with sections 09 , 10 , 14 subsection 1 E of the Constitution.

He added that section 4, 5 section 13, subsection one of the draft bill are inconsistent with the new constitution as the Supreme Court also determined that section 12 of the draft bill is inconsistent with sections 9, 10, 12 and 14 subsection 1 E of the constitution. And according to section 83 the bill could only be passed by a majority vote in parliament and referendum.

He went on to note that if the aforementioned sections are amended, the inconsistency on those sections will be removed. And by the removal of Article B – subsections 2.3, 2.4, Section 4 and Section 5 and also making amendments as determined by the Supreme Court on sections 2.2, 11.2 and 13.1 the other means of the draft bill will not be inconsistent with the Constitution.
