The Colombo High Court has today (29) said that it would decide on December 1 whether the video footage on former Army Commander and DNA Leader Sarath Fonseka’s speech handed in by a private television station could be considered as evidence.

The court has said that it would decide on the video footage handed in by Derana TV on Fonseka’s speech made in Ratnapura during the Presidential election campaign could be considered as evidence.

The respective video footage is believed to have evidence required in the controversial “white flag” case against Fonseka, that is currently being heard in the Colombo High Court.

Derana TV was ordered to present to court the original footage of the speech, but the station had informed court that the original footage was not available.

The defence counsel objected and said that the video footage could not be considered as evidence without the original footage. The prosecution has however said there were legal provisions to include such videos.

The three member panel of judges has said it would make a final decision on the video footage on December 1.
