Speaker informs parliament of SC’s determination on draft of Right to Information Bill
The Supreme Court has held that several provisions in the draft of the Right to Information Bill are in violation of the Constitution. Speaker Karu Jayasuriya informed Parliament of the Supreme Court’s determination when parliamentary sessions commenced this afternoon.
Speaker, Karu Jayasuriya stated that he would like to inform that he has received the decision of the Supreme Court.
He added that section 05/1/A of the draft bill violates articles 3/4/12/1 and 14/A/2 of the constitution while section 09/02/A violaties articles 3/4/12/1 and 14 of the constitution while section 19.
Explaining further, he added that Right to Information Bill violates articles 3/4/12/1 and 55 of the constitution while sections 43/A and 43/O is inconsistent with articles 3/4 and 14/A of the constitution.
He stated:
The Bill can only be passed in its current state, under the provisions of article 84/2 of the Constitution and by a special majority. I order that the decision of the Supreme Court be printed on the day’s Parliamentary Hansard.
